Website Terms of Use

These Terms govern elgentic.ai and Elgentic’s public live demonstration (the “Site”). The Site is operated by Elgentic LLC, doing business as Elgentic AI (“Elgentic,” “we,” “us”). These Terms do not govern paid or pilot business-customer use of Elgentic Reception, which is governed by the customer’s accepted agreement, order form, and related documents. Operational SMS has separate SMS Terms.

1. Eligibility and acceptance

You must be at least 18 and able to enter a binding agreement to use an interactive Site feature. By using the Site, you agree to these Terms and the Privacy Policy. If you act for a business, you represent that you have authority to do so.

A person can call the public demo without first visiting the Site. Elgentic does not rely only on passive website publication to establish permission for recording or transcription. The demo provides an AI identity, notice, and consent question at the beginning of the call.

2. Informational site

Site descriptions, examples, pilot availability, and estimated outcomes are general information, not a guarantee or an offer that can be accepted without an order form. Capabilities depend on configuration, compatible providers, review, and launch readiness.

3. Live demo

The live demo is a fictional practice business called Aster Row Salon and uses an AI receptionist named Dia. It is not a real salon and provides no real services. Appointments, staff, services, prices, availability, messages, and business details in the demo are fictional unless clearly stated otherwise.

Use fictional information. Do not provide payment-card data, government identifiers, health information, confidential business information, or another person’s personal information. The call may be recorded and transcribed from connection, including the caller’s response to the opening notice and consent question. If the caller declines or does not clearly agree after a clarification, the automated demo ends without handling the request. See the demo page and Privacy Policy. Usage and abuse limits apply.

The demo is not an emergency service and must not be used for medical, legal, financial, safety-critical, employment, housing, credit, insurance, or other high-impact advice or eligibility decisions. AI output may be incorrect or misunderstood and is not professional advice or confirmation of a real appointment.

4. Permitted use

You may use the Site to learn about Elgentic, experience the demo, request information, or apply for a pilot. You may not:

use the Site or demo unlawfully, fraudulently, deceptively, or to harm another person;
interfere with, overload, scrape at scale, reverse engineer, or bypass access, rate, safety, or security controls;
submit malware, malicious instructions, or content designed to compromise a system;
impersonate another person or falsely claim authority for a business;
use Site content or the demo to build, train, benchmark, or market a competing system without written permission;
submit a person’s voice, likeness, confidential information, or protected work without authority; or
violate intellectual-property, privacy, export-control, sanctions, anti-bribery, or other applicable laws.

5. Requests and communications

Submitting a form or requesting a setup review does not create a customer relationship, reserve a pilot opening, or authorize a charge. Elgentic may respond using the contact information provided. Operational SMS requires the separate opt-in shown at collection; marketing communications require any consent applicable to that communication.

6. Intellectual property and submitted content

Elgentic and its licensors own the Site, demo, software, text, designs, trademarks, logos, audio, and other materials except content clearly identified as belonging to a third party. These Terms grant only a limited, revocable right to use the Site for its intended purpose.

If you voluntarily provide general feedback that contains no confidential or personal information, Elgentic may use it without obligation. This does not authorize us to publish your identity, business name, or a testimonial. For other content submitted through the Site, you retain your rights and grant Elgentic only the rights reasonably necessary to host, transmit, secure, support, and operate the specific interaction. This license does not authorize generalized AI-model training, publicity, or sale of that content.

7. Third-party services and privacy

The Site may link to or depend on third-party telephone, voice AI, hosting, analytics, scheduling, identity, payment, or other services. Their terms and privacy practices apply to their services. A link does not mean Elgentic controls or endorses them. Our Privacy Policy describes the relevant provider categories and data practices. Business customers may obtain the named subprocessor list through their customer documentation or by request.

8. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND DEMO ARE PROVIDED “AS IS” AND “AS AVAILABLE.” ELGENTIC DOES NOT WARRANT THAT THEY WILL BE UNINTERRUPTED, ERROR-FREE, ACCURATE, SECURE, OR SUITABLE FOR A PARTICULAR BUSINESS. AI RESPONSES MAY BE INCOMPLETE, INCORRECT, OR MISUNDERSTOOD.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELGENTIC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM THE FREE SITE OR DEMO. ELGENTIC’S TOTAL LIABILITY ARISING FROM FREE SITE OR DEMO USE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT LEGALLY BE EXCLUDED.

10. Suspension and termination

Elgentic may limit or end access to protect callers, customers, providers, the public, or the Site; respond to unlawful or prohibited use; comply with law; or maintain the demo. Provisions that by nature should survive, including ownership, disclaimers, liability, and disputes, survive.

11. Changes

We may update these Terms and will post a new effective date. Material changes apply prospectively, with additional notice or affirmative acceptance where required. A Terms update will not retroactively authorize a new use of previously collected call content or personal information.

12. Governing law and contact

Texas law governs these Terms without regard to conflict-of-law principles. Before filing a claim, please send a written description to legal@elgentic.ai so the parties can try to resolve it informally. Applicable law governs jurisdiction and venue.
